Terms of Service

These Terms of Service govern the relationship between Nickel City Property Management (“Company”) and its clients (“Client”) for property management and related services.

Non-Disclosure

Nickel City Property Management implements proprietary methods in its property management operations, listings, marketing campaigns, internal processes, and related business activities. The Client agrees not to disclose, disseminate, or communicate to any public, private, or non–Company-approved source any confidential information regarding the Company, including but not limited to its business practices, systems, pricing models, employees, contractors, or personal data.

The Client and its affiliates may not distribute any forms, contracts, documents, contacts, or other materials provided by the Company unless expressly authorized in writing by Nickel City Property Management.

Copyrights & Trademarks

The Client represents and warrants that all text, images, graphics, photographs, designs, videos, trademarks, or other materials provided to Nickel City Property Management are either owned by the Client or used with proper authorization from the rightful owner.

The Client agrees to defend, indemnify, and hold harmless Nickel City Property Management and its officers, employees, agents, and affiliates from any claims, disputes, or legal actions arising from the use of Client-provided materials.

Indemnification

The Client agrees to indemnify and hold harmless Nickel City Property Management from all claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or related to the delivery of services, Client actions, or materials supplied by the Client.

Rights Upon Termination of Agreement

Upon termination of services and settlement of all outstanding balances, Nickel City Property Management will return to the Client any Client-owned property or materials in the Company’s possession.

Litigation and Governing Law

Any dispute arising from or relating to this agreement shall be resolved through arbitration or litigation in the state where the agreement was executed. This agreement shall be governed by and construed in accordance with the laws of the applicable state.

Payment of Services

The Client agrees to compensate Nickel City Property Management according to the agreed one-time or recurring payment structure, as outlined in the applicable service agreement.

Any intent to terminate services must be provided at least forty-five (45) days in advance via email or certified mail. Payment obligations remain enforceable regardless of payment method.

Termination of Services

Upon termination, Nickel City Property Management may provide Client-related data at its discretion, exercised reasonably. The Client agrees not to withhold payment as leverage for data access or dispute resolution.

The Company reserves the right to terminate this agreement if the Client breaches or intends to breach any provision of these Terms of Service.

Guarantees

Nickel City Property Management makes no guarantees regarding property performance, tenant behavior, occupancy rates, or return on investment.

Promise to Pay

The Client agrees to pay all property management fees and related costs as agreed. All payments must be made in United States Dollars.

Collection Costs

In the event of non-payment, the Client shall be responsible for all costs associated with collection efforts, including attorney’s fees, court costs, and collection agency fees, as permitted by law.

No Oral Modification

These Terms of Service may only be modified in writing. This document constitutes the entire agreement between Nickel City Property Management and the Client, superseding all prior discussions or agreements unless amended in writing.

Communications

Nickel City Property Management communicates with property owners, tenants, vendors, and prospective clients via email, phone calls, and messaging platforms, including SMS. Individuals may opt in or opt out of these communication methods at any time.
